These Terms and Conditions govern the provision of consultancy services by ProCom (“we”, “us”, “our”) to the client (“you”, “your”). By instructing us, using our website, or accepting a quotation, you agree to be bound by these Terms and Conditions.
2. Scope of Services
Services are provided as outlined in our written quotation, proposal, or agreement. Any additional services requested outside the agreed scope may be subject to additional fees and revised timescales.
We provide professional consultancy services only. We do not act as contractor, principal designer (unless expressly agreed in writing), or statutory authority.
3. Professional Standard of Care
All services are carried out with reasonable care and skill in accordance with applicable UK legislation, recognised guidance, and industry best practice at the time the services are provided.
Compliance with legislation or guidance does not guarantee planning permission, building control approval, or any other statutory consent.
4. Planning Permission and Building Control
Decisions relating to planning permission, building regulations approval, or other statutory consents are made solely by the relevant authorities.
Local Planning Authorities and Building Control Bodies may apply local interpretations or additional requirements that vary by geographical area. We accept no liability for refusals, delays, or conditions imposed by statutory authorities.
The contractor carrying out the works is responsible for confirming with the appointed Building Control Inspector (Local Authority or Approved Inspector) that any specification, drawing, or detail provided is sufficient to meet the Building Regulations applicable to the site and location.
5. Client Responsibilities
You are responsible for:

Providing accurate, complete, and timely information

Appointing competent contractors and consultants

Ensuring works are carried out in accordance with approved designs and statutory approvals

Obtaining any necessary permissions unless expressly agreed otherwise
We shall not be liable for errors or delays arising from inaccurate or incomplete information supplied by you or third parties.
6. Fees and Payment
Fees are as set out in our quotation or agreement and are exclusive of VAT unless stated otherwise.
Payment terms are [e.g. 14 days from invoice date]. We reserve the right to suspend services for non-payment.
7. Refunds and Cancellations

11. Confidentiality
We will treat all client information as confidential unless disclosure is required by law or agreed in writing.
12. Termination
Either party may terminate the agreement by written notice. Fees remain payable for all work completed up to the date of termination.
13. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
